Cheque

It is a written payment order used by the drawer to withdraw, to his benefit or the benefit of a third party, all or part of the available funds in his account opened with the drawee. The check is also considered as a payment instrument. As such, its transmission is made by means of endorsement: 

  • by transmission of property: endorser transmits ipso facto the property of the provision
  • by way of proxy: the endorsement does not transfer property of the check, but gives the endorsee (a bank) the order to cash the cheque on behalf of the endorser
