WHAT IS THE CENTRAL CHECK PAYMENT INCIDENT REGISTER ?

The Central Check Payment Incident Register (CCPIR) centralizes and disseminates to credit institutions the declarations of check payment incidents and judicial prohibitions. The CCPIR records data on : 

  • Check payment incidents and bans on issuing checks
  • Legal prohibitions of issuing checks
  • Injunctions to stop issuing checks and breaches of judicial injunctions and prohibitions

 

WHAT IS A PAYMENT INCIDENT ?

The default or insufficient provision is a payment incident. The latter is considered an offense severely punished by the law, which provides in particular for : 

  • A bank ban to stop issuing checks for 10 years, unless it is settled
  • as well as a criminal sanction (fine, imprisonment) in case of legal prosecution

 

IN WHICH CASE CAN I BE REGISTERED IN THE CCPIR ?

You are registered in the CCPIR in the case of: 

  • a bank prohibition of issuing checks: You have issued a bad check and the check has been rejected by your bank for lack of provision. Your bank then sends you an injunction letter informing you of the rejection, its consequences, and the means you can use to settle your situation. 
  • a judicial ban to issue checks: If a ruling given by a court provides for such a measure against you.

 

HOW LONG DO I REMAIN REGISTERED IN THE CCPIR ?

Unregulated payment incidents are stored for 10 years, while judicial bans are retained from 1 to 5 years after being reported to the service.

Payment incidents that are settled or canceled are no longer retained as soon as the relevant banking institution declares them so. As a result, you legally resume the ability to issue checks.

 

HOW TO SETTLE MY SITUATION IF I AM REGISTERED IN THE CCPIR ?

You are registered in the CCPIR for a ban on issuing checks after a check has been rejected and you want to be able to issue checks, please follow these steps : 

  • Settle the check amount subject of the incident:
    • Either directly to the beneficiary, and by retrieving the check in question,
    • or by making an adequate and available provision with the drawee banking institution
  • Pay the tax penalty:
    • 5% of the amount of the unpaid check (s) subject of the 1st injunction
    • 10% of the amount of the unpaid check or checks subject of the 2nd injunction
    • 20% of the amount of the unpaid check or checks subject of the third and following injunctions.
  • Provide the supporting documents to the bank which will have to make a declaration of the settlement to the CCPIR within the set deadlines.

 

WHAT ARE THE CASES WHEN YOU CAN CHALLENGE YOUR REGISTRATION IN THE CCPIR ?

In the case of an erroneous ban by a banking institution that may occur, for example, following an identification error, you can : 

  • In the case of a bank ban, require your bank to make a new declaration to the CCPIR to cancel the payment incident
  • In the case of a judicial ban, refer the matter to the President of the Court in order to  waive this erroneous prohibition

In accordance with the provisions of law 09-08 relating to the protection of individuals with regard to the processing of personal data, you can have access to information on you which is registered in this file.
